Ivan Mikchailau returned guilty of criminal offence on “draft evasion”. Punishment will be applied in form of 3 months of arrest. Today, on February 1, 2010, a court hearing resumed on the case of Ivan Mikhailau who refuses military service upon religious beliefs and demands assignment of civilian (alternative) service, which goes along with provisions of Art. 57 of the Constitution of the Republic of Belarus.
Ivan Mikhailau was brought to court under convoy from Zhodzina pre-trial prison where he has been placed since the momentof his arrest on December 20, 2009. Prosecutor Cherepovich during the hearing of arguments demands that Ivan Mikhailau should return guilty of criminal offenceand requests application of punishment in form of 5 months of arrest for him.Ivan Mikhailau does not plead guilty, he demands withdrawal of all draft evasion charges and insists that his right to alternative civilian service should be observed; Ivan does not accept military service by any means.Lawyer Svyatlana Harbatok in her speech numerously referred to Art. 57 of the Constitution of the Republic of Belarus, according to which citizens have the right to alternative civilian service and this right should be ensured and mentioned a CIS Model Law “On Alternative (non-military) Service”. The lawyer pleaded her client non-guilty, and demanded that his right to alternative civilian service should be observed. Lack of specific legislation may not be considered a legal
base for violation of the rights of Ivan Mikhailau.
Ivan Mikhailau insists that he is non-guilty and did not evade the draft to the military. He demands alternative service and grounds this demand on the fact that it is not his guilt that the Parliament and other responsible state institutions are idle about the adoption of the law. Judge Minich A.N., on behalf of the Republic of Belarus, enacted to return Ivan MIkhailau guilty of the criminal offence and apply a punishment in form of
3 months of arrest. The judgement will come into effect after the appeal into a higher instance. Ivan Mikhailau will launch a cassation appeal into the Minks Oblast Court. Untill the case is considered in the court of higher instance, Ivan Mikhailau will remain in Zhodzina pre-trial prison. Public Campaign “Foralternative civilian service in Belarus” is expressing protest in connection with the verdict of criminal prosecution of Ivan Mikhailau and announces the drive for signatures under an appeal to the Prosecutor General, Chair of the Supreme Court, Chair of the Constitutional Court and the Speaker of the Chamber of Representatives of the National Assembly (Parliament) of the Republic of Belarus. Tatoha, В Интернете появились данные очередного политического призывника, фамилия которому Михайлов. Чего только не делают люди, чтобы откосить от армии. Мы с Иваном учились в «энергетике», так по простому называют наш колледж и никогда не думал, что именно Ванюха станет так известен в нете. Парень он хороший, кампанейский, без забабахов. Никакой религией в то время не увлекался, вообще был далек от этого. С учебой правда всегда были проблемы, не хватало усердия да и мозгов. Два раза поступал, два раза учился, но все же его окончательно выперли по причине неуспеваемости. Еще запомнилось, что домой он не очень спешил, старался подольше сидеть в колледже, говорил что дома напряг. Мамка у него была очень активной и напористой, преподы с ней связываться не хотели, всегда искали причину избежать общения. Думаю воякам, которые Ваню призывали от нее то же досталось. А вообще жалко на все это смотреть, у нас из группы большинство ребят отслужили или закончили военную кафедру в ВУЗах и Иван вроде не из хлюпиков, чего такой скандал раздувать. Большинство пацанов конечно бы служить не пошли будь выбор, но ведь гнилых отмазок тоже не ищут. Смотрят такие как наш Ванька на Европу, просят у нее поддержки и понимания, а ведь если посмотреть, то в Европе своих проблем со службой хватает. А вообще почитаешь про этих политпризывников и думаешь, они что ненормальные? Как можно из себя делать ущербных да еще и пиарить это по всей паутине.
